This Privacy Policy governs the websites, apps, offline locations or services owned and operated by Aimmune Therapeutics Manufacturing LLC (hereinafter referred to as “Nestlé Health Science U.S.”) that display, reference, or link to this Privacy Policy. The GoodNature Program (“GoodNature,” “our,” “we” or “us”) respects your privacy, and we want you to be familiar with how we collect, use, share, or otherwise process your personal information when you visit our website or interact with GoodNature online, participate as a GoodNature donor, or use other GoodNature services that link to this Privacy Notice (collectively, our “Programs”).

In this Privacy Notice, “personal information” refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to an individual, and includes “personal data” or similar terms as defined in applicable law.

Please read this Notice carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, please do not use the website or apply to become a donor.

NOTICE AT COLLECTION OF PERSONAL INFORMATION

We collect several categories of personal information through our website and from donors and prospective donors:

  • Identifiers/biographical information, including name, postal and email address, phone number, if you choose to provide them to us. We automatically collect device identifiers such as Internet Protocol (“IP”) address, and identifiers and other information that are stored in cookies and similar technologies.
  • Internet or other electronic network activity information, including the pages that you visit and the amount of time you spend viewing the Website, keystrokes, mouse movements, form field entries; browser type, device type, operating system, and recordings of chat sessions or your use of and inputs to other AI-supported tools.
  • Location Information, based on the IP address assigned to the device you use to access our website. If you apply to become or serve as a donor, we will collect your home address and information about locations to which have traveled.
  • Protected classifications, such as your age and gender.
  • Sensitive personal information. If you are a donor, we will collect information related to your health and medical condition(s), which may include genetic data or biometric information medical treatments, medications, and test results; sexual orientation; and gender identity. We also may collect our precise geolocation and the username and password associated with an account you establish on our website
  • Inferences based on the information described above, particularly your eligibility to become a GoodNature donor.

Personal Information Uses. GoodNature collects these categories of personal information to operate, improve, and protect our website; evaluate and communicate with donors;  and comply with our legal obligations.

“Sharing” Personal Information. We “share” (as such terms are defined in U.S. law) some of the personal information that we collect through our website. We do not sell or share sensitive personal information that you provide on this website.   The information that we share is limited to certain data about how you use our website and the pages you view. We make this information available to data analytics providers and social media platforms. In particular, we use Google Analytics to collect Personal Information, including identifiers and information about your activity on our Website, for remarketing, impression reporting, and demographic and interest reporting.

Data Retention. We will retain your personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including administering our donor program and meeting all related compliance obligations. We also retain personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Our data retention period reflect several factors, including whether you become a donor and how long you remain a donor, the nature and sensitivity of personal information, and what is reasonably necessary and proportionate to provide and improve our website.

In general, GoodNature’s uses of personal information vary depending on our relationship with you. Below we describe how we use personal information from website visitors, donors, and job applicants/employees.

Website Visitors

If you visit the GoodNature website but do not apply to become a donor, we use your personal information to:

  • Operate, analyze, improve, and secure our website
  • Respond to your requests for additional information about GoodNature and its donor program
  • Tailor marketing programs, administer retargeting messaging and profiling activities of GoodNature, its affiliates, collaborators, or licensees
  • Send newsletters and marketing information relating to GoodNature’s products
  • Respond to questions on recruitment to our clinical trials or refer you to specific organizations that may provide information on how to participate in clinical trials
  • Provide information relating to products in development
  • Address questions related to products in development, or in market, or deliver requested information on resources available related to the therapeutic areas or other medical or scientific areas that GoodNature provides.
  • Cookies and Similar Technologies. We and our authorized third parties use cookies and similar technologies (such as web beacons, tags, and scripts) to collect and store analytics and other information when you use our website(s). These technologies automatically collect and store information such as your web browser type, your IP address, the date and time of your website visits, and the pages that you visit on the website. These technologies can help us to share content from our social media sites, gain helpful insights about how our Services are used and how we can improve your experiences and interactions during your use of our website.

Donors and Prospective Donors

If you apply to become a donor, or are accepted to and participate in our donor program, we use your personal information to: 

  • Provide and manage the donor program, clinical research opportunities, and other related Programs
  • Fulfill our obligations to you under an applicable contract or to conduct business with you
  • Identify and engage thought leaders and external experts
  • Communicate with you about our Donor program
  • Conduct surveys, or polls and obtain testimonials
  • Process and manage safety and quality concerns
  • For any other purpose disclosed by us when you provide the information

In addition, we may combine the personal information we collect about you from one source with the personal information we collect about you from another source, such as combining online information with our offline interactions with you, from public records or websites, or other third parties (e.g., health care professionals, patient groups, government agencies). If necessary, we will collect your consent, or provide an opportunity for you to opt out of this type of processing.

All Individuals

Regardless of how we interact with you – as a website visitor or donor we use your personal information to:

  • Comply with applicable laws
  • Respond to legitimate requests from government authorities, including authorities that may be outside of your country of residence
  • Protect or defend our legal interests, and if necessary, to protect the safety of our employees and third parties
  • Fulfill any other purpose for which we have your consent
  • Evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, joint venture, or other sale, transfer or disposition of some or all of our assets, whether in connection with any bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred

Aggregated and Anonymous Information

We may de-identify or aggregate Personal Information so that it will no longer be considered Personal Information. Our use and disclosure of de-identified information is not governed by this Privacy Notice.

We may disclose your personal information to:

  • Our subsidiaries and corporate affiliates
  • Service providers working on our behalf, or providing services such as information technology, website hosting, payment processing, order fulfillment, customer service, etc.
  • Advertising and analytics providers, such as ad platforms, to help us advertise more effectively, including through targeted advertising
  • Third parties to whom you authorize us to disclose your personal information in connection with our Programs
  • Authorized law enforcement, regulatory or other government authorities, where required by applicable law, or pursuant to a valid subpoena
  • Business partners with whom we collaborate regarding our investigational products and programs, such as scientific advisors, joint venture partners and strategic collaboration partners
  • Third parties to protect GoodNature’s rights and interests, such as when needed for corporate audits, to investigate or respond to a complaint or threat, or to exercise our legal rights

We may contact you periodically by email, for example, if you have opted in to receive emails from us, to provide information regarding our Programs and provide you with content that may be of interest to you. You can opt out of receiving promotional communications by clicking on the “unsubscribe” button at the bottom of applicable email communications. In addition, some of the features on our website(s) allow you to contact us by phone or submitting an online form. We will respond to you via your requested channel, or that most appropriate to resolve your request, including phone, fax, SMS, and email.

  1. SMS Policy

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Privacy Rights and Requests

Depending on your U.S. state of residence, you may have certain rights over your personal information, including the right to:

  • Opt out of sales, sharing, and targeted advertising (as these terms are defined in applicable law). You may request to opt out of the sale or share of your Personal Information, or of targeted advertising, at any time by emailing us at privacy@goodnatureprogram.com.
  • Right to Know: You may have the right to request that we provide you with what Personal Information we have collected about you, including the categories of Personal Information,  the business or commercial purpose for collecting, selling, or sharing Personal Information, the categories of third parties to whom we disclose Personal Information, and the specific pieces of Personal Information we have collected about you, unless your request proves impossible or would involve disproportionate effort to fulfill. Please note that we may not be required to respond to your requests “to know” or access specific pieces of Personal Information more than twice in any 12-month period.
  • Access your Personal Information in a portable format.
  • Delete your Personal Information, subject to certain exceptions.
  • Correct inaccurate personal information that we maintain about you, subject to appropriate verification.

Please put the statement “Your Privacy Rights” in the subject field of your email. We may take steps to verify your identity before responding to your request by asking you a series of questions about your previous interactions with us. Submitting a privacy rights request does not require you to create an account with us.

We may decline a request (other than an opt-out request) if we are unable to verify your identity (or an agent’s authority to make the request) and confirm the Personal Information we maintain relates to you.

We will not discriminate against you if you decide to exercise your privacy rights. 

Agent Requests

Only you, or someone legally authorized to act on your behalf, may submit a request related to your personal information.

Depending on your U.S. state of residence, you may authorize someone to make a privacy rights request on your behalf (an “Authorized Agent”). As part of our verification process, Authorized Agents will need to demonstrate that you’ve authorized them to act on your behalf, such as by providing a copy of your signed authorization. GoodNature retains the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the agent’s identity.

Industry-Based Advertising Choices

In addition to the option to opt out of targeted advertising through our website, you can opt out of receiving certain targeted or interest-based advertisements using tools provided by advertising industry. You will still receive ads, but they might be less relevant to your interests.

You will need to opt out separately on all of your browsers and devices. If you delete or reset your cookies or mobile identifiers, change browsers, or use a different device, you may need to repeat the opt-out process for that device or browser.

Unsubscribing from our Marketing and Promotional Communications

From time to time, we may send you marketing and promotional communications. If you no longer wish to these emails from us, you may opt out by following the instructions included in any promotional or marketing email you receive from us.

As a courtesy to you, our website(s) may provide links to other websites not operated by GoodNature.  This Privacy Notice does not address, and GoodNature is not responsible for, the terms of use, information, or privacy practices of any third parties including third parties that may operate websites or provide services to which our website or services link. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

  1. Safeguarding Your Personal Information

We have implemented and maintain reasonable physical, technical, and administrative security measures to protect personal information collected and used as described in this Privacy Notice. However, no data security measures can protect against all threats, and we cannot guarantee the security of activities, transmissions or communications conducted via the Internet.

We care about protecting the online privacy of children. We will not knowingly collect any personal information from anyone under the age of 18. If we become aware that we have collected personal information from anyone under the age of 18, we will take steps to delete the information.

GoodNature may update or make changes to this Privacy Notice from time to time, at our discretion. We encourage you to visit this page periodically and to review our most current Privacy Notice and applicable effective date. If we make material changes to how will treat your personal information, we will provide appropriate notice to you, such as through a temporary banner on our website, an email sent to users for whom we have an email address, or by temporarily noting “UPDATED” next to the Notice’s link on the footer of our website.   .
